Use and Service

Welcome to the official terms of service and use for artwork created by N.F. Mayrune, also known as Mayrune. By commissioning or purchasing any artwork from Mayrune, you (the “Client” or “Commissionee”) agree to the following terms and conditions.

1. General Terms

1.1 Acceptance: By commissioning artwork from Mayrune, you acknowledge that you have read, understood, and agree to these terms.

1.2 Content Restrictions: Mayrune reserves the right to refuse any commission that involves content that is offensive, discriminatory, or otherwise objectionable.

1.3 Communication: All communication regarding commissions will be conducted via email or a mutually agreed-upon platform.

2. Commission Process

2.1 Request: The Client must provide a clear and detailed description of the desired artwork, including any specific requirements or references.

2.2 Approval: Once the request is received, Mayrune will confirm acceptance of the commission and provide an estimated completion time and cost.

2.3 Payment: All payments must be up-front. A refund can be provided only due to specific circumstances that are agreed upon (Unable to complete the commission due to circumstances or unable to match requested time limit)

2.4 Revisions: The Client is entitled to up to three rounds of minor revisions. Any additional revisions or major changes may incur extra charges.

2.5 Completion: Upon final approval and receipt of full payment, artwork will be completed and delivered to the Client with the requested format.

3. Payment

3.1 Currency: All payments will be made in CAD unless otherwise agreed upon.

3.2 Methods: Accepted payment methods include PayPal, bank transfer, and other mutually agreed upon methods.

3.3 Refunds: Full refunds are only available if Mayrune cancels the commission before completion. Partial refunds may be issued at Mayrune’s discretion based on the amount of work completed.

4. Rights and Usage

4.1 Artist’s Rights: Mayrune retains all rights to the commissioned artwork, including but not limited to the right to display the artwork in portfolios, websites, social media, and other promotional materials.

4.2 Client’s Rights: The Client receives rights to use the commissioned artwork for personal, non-commercial purposes. This includes printing for personal use, displaying on personal websites or social media with proper credit to Mayrune.

4.3 Commercial Use: Any use of the commissioned artwork for commercial purposes (e.g., merchandise, branding) requires a separate licensing agreement and additional fees. Credit and confirmation of Commercial use must be approved by Mayrune for use.

4.4 Credit: When displaying the commissioned artwork publicly, the Client must credit Mayrune by including a link to the artist’s portfolio/website or a clear mention of the artist’s name. If lack of Credit is brought up to Mayrune’s attention, reporting of the poster will be made regarding the lack of credit or approval.

4.5 Alterations: The Client may not alter the commissioned artwork without prior consent from Mayrune. This includes editing, modifying, or using parts of the artwork in other works.

5. Confidentiality

5.1 Privacy: Mayrune respects the privacy of the Client and agrees to keep any personal information confidential unless required by law.

6. Liability

6.1 Damage: Mayrune is not responsible for any damage or loss of the commissioned artwork once it has been delivered to the Client.

6.2 Usage: Mayrune is not liable for any misuse of the commissioned artwork by the Client or any third parties.

7. Termination

7.1 Mutual Agreement: Both parties may agree to terminate the commission at any time. In such cases, refunds or payments will be handled as per section 3.3.

7.2 Breach of Terms: Failure to comply with these terms may result in termination of the commission and forfeiture of any rights granted to the Client.

8. Amendments

8.1 Changes: Mayrune reserves the right to amend these terms at any time. Clients will be notified of any significant changes.

9. Governing Law

9.1 Jurisdiction: These terms are governed by the laws of Canada. Any disputes arising from these terms will be resolved in the courts of Canada.
